Westerly Magazine strives to offer the best possible service to our readers, supporters and subscribers. If you have any queries or concerns about your subscription, purchase or Westerly account please refer to the following Terms and Conditions or contact us.
Membership
- In order to create or activate your digital subscription, you will be required to create an online Westerly account. When registering as a member, you must provide us with accurate, complete and up-to-date registration information, as requested.
- It is your responsibility to inform us of any changes to your registration information. Your information will only be used for the purpose of managing your subscription.
Managing your Digital Subscription
- You can manage your account and personal details online through Your Account.
Processing and Payment
- Westerly will process your digital subscription purchase immediately after payment at checkout. Payments are processed though Stripe payment gateway. Your payment details must be verified before your subscription can be activated.
- If your initial payment authorisation is revoked, your subscription will be terminated. We reserve the right to reject any subscription order at any time.
- All digital subscriptions renew automatically, with the exception of the 12 Month Subscription and Gift Subscription. Payment for digital subscriptions will be debited from your nominated account annually unless you cancel according to our cancellation policy (see below).
- You will be notified by email one week prior to the payment processing date of your rolling subscription, and will receive a tax invoice and email notification following successful payment.
- It is your responsibility to provide valid payment details and ensure that your payment details are up to date.
- It is your responsibility to ensure there are sufficient clear funds available in your account to allow a debit payment to be made in accordance with a direct debit request. You can manage payment details online through Your Account.
- If your credit card expires or your payment method is otherwise invalid, your subscription may automatically be cancelled.
- In the event that an automatic payment fails for any reason, you will be notified by email. Payment will be re-attempted after 3 days, then every 5 days. If payment is unsuccessful on the fourth attempt, your subscription will be cancelled.
- Unless specified otherwise, all charges are non-refundable.
Pricing
- When you purchase a digital subscription, you agree to pay the price stated at the time of your order. You also agree to the billing frequency specified at the time of your order.
- All prices are in Australian Dollars (AUD) and include Goods and Services Tax (GST).
- Any discount eligibility is determined at the time of order. Discounts cannot be applied retrospectively.
- Westerly reserves the right to change the prices and fees at any time. We will provide you with 14 days’ notice if the regular rate of a digital subscription changes from what was stated at the time of your order.
- Price changes will take effect from your next billing date after the notice period. If you do not wish to continue your Digital Subscription at the revised price, you may cancel your subscription before the end of your current direct debit pay cycle. You can cancel at any time through Your Account or by emailing us at westerly@uwa.edu.au.
Promotions
- Westerly may at times offer special promotions and offers. The specific terms and conditions of each offer will be stated at the time of the promotion and will apply in addition to the general Terms and Conditions. In the event of any inconsistency between the Terms and Conditions of a special offer and the general Terms and Conditions, these general Terms and Conditions will apply.
- Promotional codes are valid for one use only, on selected products, unless stated otherwise. Where a discount has been applied to a rolling subscription, the reduced price will be valid for one year, after which the regular listed price will be billed.
- We reserve the right under special circumstances to enable free access to our subscriber content for a limited period of time. During this time existing subscribers will not be eligible for a refund.
Gift Subscriptions
- You can elect to manage or change the details of the name and email address of the recipient of your gift by contacting us at westerly@uwa.edu.au or in writing to M202, The University of Western Australia, 35 Stirling Hwy, Crawley, WA 6009.
- It is your responsibility as a gift purchaser to ensure that the gift recipient’s email address, name and details of the gift are correct.
Cancellations
- You can cancel your subscription at any time through Your Account, by contacting Westerly Magazine via email at westerly@uwa.edu.au, or in writing to M202, The University of Western Australia, 35 Stirling Hwy, Crawley, WA 6009.
- When you cancel, you cancel only future charges associated with your subscription. You may notify us of your intent to cancel at any time, but the cancellation will become effective at the end of your current billing period. You will continue to have the same access and benefits until the end of your current billing period.
- Email and written cancellations must be received at least 3 working days before your next billing date otherwise we may not be able to stop your next payment being deducted.
Suspension Policy
- Digital subscriptions cannot be suspended under any circumstances. If your package includes a hard copy component, you can suspend the delivery of the magazine to your address. You will not be entitled to any refund in respect of the suspension period. Delivery will not be made during any suspension period notified to Westerly. Please allow a minimum of 3 working days for the suspension to be processed.
Westerly’s right to change digital products
- Westerly reserves the right to modify the content, inclusions, type and availability of any digital product at any time. In the event your subscription package changes, you will be given 14 days notification prior to when you would need to make a decision to cancel and not be affected. Your package change will automatically take place from your next billing cycle.
- If any or all of our digital products are temporarily unavailable, you will not automatically be entitled to receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
Your Privacy
- You agree that your name, address, email address and telephone number will be collected and stored by Westerly and used for the purpose of managing your subscription, communicating with you about your subscription. You will not receive any other general correspondence (e.g. newsletter) from us unless you choose to join out mailing list.
Disclaimers
- You agree that any errors made in entering your contact information and order details are your responsibility and Westerly is not liable for any consequences that may arise as a result of such errors or incorrect information, including but not limited to sending the subscription to the address as notified by you.
- To the extent permitted by law, Westerly is not liable to you for any loss or damage incurred by you in connection with your subscription, whether direct, consequential, special, indirect or other loss or damage. In any event, Westerly‘s maximum liability to you is limited to the value of the subscription fees paid within the previous twelve months.
- The opinions expressed in Westerly are those of individual contributors, and not of the Editors or Editorial Advisors.
Your Obligations
- It is your responsibility to report to Westerly if magazine deliveries continue to be made and/or payments continue to be deducted, if you believe a cancellation should have been processed.
- It is your responsibility to check your account statements to verify that the amounts debited from your account are correct and notify Westerly if you believe you are being billed incorrectly.
- Westerly will not refund past subscription payments if a subscriber has failed to contact us directly to cancel, or to report unexpected payments or non-delivery.
General
- You acknowledge that these Subscription Terms and Conditions may be modified by Westerly from time to time, including but not limited to terms relating to fees and charges, cancellation and modifying your subscription.
- You will be notified of any changes to these Subscriptions Terms and Conditions.
Publication
- In submitting work to the Magazine, you are declaring that it is original, and solely of your own production (unless otherwise disclosed as collaborative).
- All authors published within Westerly will be required to sign an author agreement granting Westerly a non-exclusive right to publish their content both in hardcopy and digitally.
- We ask that all authors who publish their content in other publications (either hardcopy or digital) post-publication in Westerly make acknowledgment in that publication of Westerly‘s prior publication.
- Westerly accepts no liability for infringements of copyright in the work published by authors within the Magazine. All liability rests with the author. Likewise, copyright of original work published within rests with the author. The authors published within have granted Westerly a non-exclusive right to publish their content both in hardcopy and digitally.
- The opinions expressed in Westerly are those of individual contributors, and not of the Editors or Editorial Advisors.
